ELIGIBILITY:
Contest is open to legal residents of Canada who have reached the age of majority in their province/territory of residence at the time of entry, except employees or agents (and those with whom they are domiciled) of Samsung Electronics Canada Inc. (the "Sponsor"), its advertising and promotion agencies and the Contest judges (collectively, the "Contest Parties").
CONTEST PERIOD:
No purchase necessary. Contest begins on January 5, 2010 at 12:00:01 Eastern Time (ET) and ends on February 28, 2010 at 11:59:59 ET (the "Contest Period").
HOW TO ENTER:
To enter, go to www.samsung.com/burton (the "Website"), click on the "Samsung Burton Demo Days Experience" contest link, click on the "Enter" button and an entry form will appear. Fully complete the entry form, which requires you to enter: your full name, mailing address including postal code, email address and ten digit telephone number for one (1) entry into the draw.
There is a limit of one (1) Entry per person/email address permitted during the Contest Period. If it is discovered that you attempted to enter more than once during the Contest Period, then all your Entries will be considered void. Entrants may only use one (1) email address to enter the Contest. If it is discovered that you attempted to: (i) enter using more than one (1) email address; (ii) enter under more than one (1) email address; you will then be disqualified from the Contest and all of your entries will be void. Your entries will automatically be rejected if the entry form is not fully completed and submitted during the Contest Period. Use of any automated system to enter is prohibited and will automatically result in disqualification.
GRAND PRIZE:
There will be one (1) Grand Prize available to be won, consisting of a trip for two (2) to attend the Burton US Open Snowboarding event in Stratton, Vermont U.S.A., between March 16, 2010 and March 21, 2010 along with two (2) VIP US Open Access Passes; two (2) VIP Party Passes; one (1) private Burton Factory tour; one (1) Meet Jack Burton opportunity; one (1) Burton Snowboarding Package including one (1) Burton jacket; one (1) Burton pair of pants; one (1) Burton Snowboard and one set Burton Bindings; one (1) Samsung Notebook N31o and one (1) Samsung Mobile Handset (to be selected by the Sponsor) (the "Grand Prize"). The Grand Prize trip portion of the prize includes: round trip airfare (economy class) for the winner and his/her Companion to the international airport closest to Stratton, Vermont U.S.A. from one of the following major Canadian airports nearest the winner's residence (Toronto, Ontario; Calgary, Alberta; Vancouver, British Columbia; or Montreal, Quebec) on an airline chosen by Sponsor, in its sole discretion; accommodation for two (2) (double occupancy) for five (5) nights, at a hotel chosen by Sponsor, in its sole discretion; and ground transportation while in Vermont to/from the Airport to the hotel and to/from the hotel returning to the Airport and three (3) meals per day for the winner and his/her companion for six (6) days. Approximate retail value of the Grand Prize is Eight Thousand Seven Hundred Ninety Nine Dollars ($8,799.00 CDN) based on a Toronto departure example, although the actual retail value may vary depending on the point of departure.
Without limiting the generality of the foregoing, the following general conditions apply to each Grand Prize: (i) Grand Prize must be accepted as awarded and is not transferable or convertible to cash (no substitutions except at Sponsor's option); (ii) all travel related to the Grand Prize must occur on the dates specified above (otherwise the Grand Prize will be forfeited) and the winner and his/her travel companions must: (a) travel on same itinerary; (b) have all necessary documentation to permit international travel (e.g., passport); and (c) have no impediment to entry into the United States; (iii) the costs of everything not expressly stated above as being included in the Grand Prize are the responsibility of the winner his/her and travel companions, including, without limitation, additional meals, gratuities, other entertainment, merchandise, souvenirs, local and long distance telephone calls, travel and cancellation insurance, health insurance, transportation from the winner's residence to the closest gateway airport and items of a personal nature; (iv) if the winner does not utilize any part(s) of the Grand Prize, then any such part(s) not utilized will be forfeited in their entirety and nothing will be substituted in their place; (v) Contest Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including without limitation, but solely at the Contest Sponsor's sole discretion, a cash award; (vi) all travel arrangements relating to the Grand Prize must be made through the Contest Sponsor or its designated agents; (vii) by accepting the Grand Prize, the winner agrees to waive all recourse against the Contest Sponsor, and those associated with the Contest Sponsor, if the Grand Prize or a component thereof does not prove satisfactory, either in whole or in part; and (viii) each of the winner's travel companions must sign and return the Contest Sponsor's travel companion release form indicating that they waive all recourse against the Contest Sponsor relating to their participation in the Grand Prize, and in the case of a Grand Prize winner or a travel companion who is under the age of majority in his/her jurisdiction of residence, the travel companion release must be signed by that person's parent or legal guardian, who must accompany him/her on the Grand Prize trip at no cost to the Sponsor. The Grand Prize will only be awarded to the entrant whose name and e-mail address appears on the entry form.
GRAND PRIZE WINNER SELECTION PROCESS:
A random draw for the Grand Prize will be conducted at or about 2:00 pm (EST) on March 1, 2010 (the "Draw Date") in Brantford, ON, by the independent contest judging organization, from all eligible entries received as of during the Contest Period. Odds of being selected depend upon the total number of eligible entries received during the Contest Period. The Contest Sponsor or its designated representative will make three (3) attempts to contact the selected entrant by telephone within seven (7) business days of the Draw Date. If the selected entrant: (i) cannot be contacted within three (3) attempts or seven (7) business days of the Draw Date (whichever occurs first); or (ii) there is a return of any notification as undeliverable; then the selected entrant will be disqualified and an alternate entrant will be randomly selected from among the remaining eligible entries. The process noted above will be repeated until a selected entrant has been contacted or three (3) times (whichever occurs first). If contact has not been made with a selected entrant after three attempts (in accordance with this section), then the Grand Prize will not be awarded.
Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question. The selected entrant will also be required to sign and return the Contest Sponsor's Declaration and Release Form (the "Release Form") confirming compliance with these Rules, acceptance of the Grand Prize as awarded without substitution, and releasing the Contest Sponsor, its affiliated and related companies, advertising and promotional agencies, the independent contest judging organization and each of their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns from any liability in connection with this Contest, the selected entrant's participation therein and/or the awarding and use/misuse of the Grand Prize or any portion thereof.
Declining the prize, failing to correctly answer the mathematical skill testing question or failing to return the properly executed Release Form within the time period indicated on the Release Form will cause the Grand Prize to be forfeited and a new random draw from the remaining eligible entries will be conducted to select another entry in accordance with the provisions noted above.
GENERAL CONDITIONS:
By entering the Contest, each entrant agrees to the use of his/her and his/her Companion's name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.
Without limitation, the Contest Parties will not be liable for any failure of the Website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Contest Parties for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Contest Parties will not be liable for any injury or damage to an entrant's or any other person's computer related to or resulting from participating or downloading any material in the Contest.
In the event of a dispute regarding who submitted an entry, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry and that he/she has all necessary consents, permissions and/or licenses as required by these Rules. The sole determinant of the time for the purposes of a valid on line entry in this Contest will be the Contest server machine(s).
The Sponsor reserves the right to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries.
BY ENTERING THIS CONTEST, ENTRANTS HEREBY RELEASE AND HOLD HARMLESS THE SPONSOR FROM ANY LIABILITY IN CONNECTION WITH THIS CONTEST OR PARTICIPATION IN ANY CONTEST RELATED ACTIVITIES OR, IF DECLARED A WINNER, ANY PRIZES, AND ANY TRAVEL RELATED THERETO. THIS CONTEST WILL RUN IN ACCORDANCE WITH THESE RULES. CONTEST SPONSOR RESERVES THE RIGHT, SUBJECT TO APPROVAL FROM THE RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX IN QUEBEC, TO CANCEL, AMEND, MODIFY OR TERMINATE THIS CONTEST OR THE RULES AT ANY TIME IN ITS SOLE DISCRETION AND WITHOUT FURTHER NOTICE. ENTRANTS MUST COMPLY WITH THE RULES, AND WILL BE DEEMED TO HAVE RECEIVED AND UNDERSTOOD THESE RULES IF HE/SHE PARTICIPATES IN THE CONTEST.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the RÉgie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the RÉgie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry (both his/her own personal information and that of his/her Companion) only for the purpose of administering the Contest and in accordance with Sponsor's privacy policy (available at http://www.samsung.com/ca/info/privacy.html), unless the entrant otherwise agrees.
